This privacy policy explains how we collect and use your personal information when you visit our website, buy from us or get in touch. We handle your information in line with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
Who we are
Pot Culture is a trading name of Invigortex Ltd, a private limited company registered in England (company number 14884570). Our registered office is C/O Philip Barnes & Co Limited, The Old Council Chambers, Halford Street, Tamworth, Staffordshire, England, B79 7RB.
Invigortex Ltd is the data controller for the personal information described in this policy. This means we decide how and why it is used. If you have any questions about this policy or your information, contact us by email at invigortex@gmail.com or via our Contact page.
The information we collect
When you place an order or create an account, we collect:
- your name, billing address and delivery address
- your email address and, if you give it, your phone number
- what you have ordered, the amount paid and your order history
- your account login details, if you choose to create an account (passwords are stored in encrypted form)
- any messages you send us, for example about an order or a return
We also collect your email address if you sign up to our newsletter, and technical information such as your IP address and browser type, which our shop software records with each order to help prevent fraud.
Your card details are entered directly with our payment provider, Stripe. We never see or store your full card number.
How we use it and our lawful bases
We only use your personal information where the law allows us to. We rely on these lawful bases:
- Contract – to process and deliver your order, take payment, handle cancellations, returns and refunds, manage your account and keep you updated about your order.
- Legal obligation – to keep order and payment records for tax and accounting purposes, and to deal with your legal rights as a consumer.
- Legitimate interests – to prevent fraud, keep our website secure, answer your questions, and improve our products and service. We only do this where our interests are not overridden by your rights and interests.
- Consent – to send you our newsletter and other marketing emails, if you have asked to receive them. You can unsubscribe at any time using the link in any email or by contacting us.
We do not sell your personal information.
Who we share it with
We only share your information with service providers who help us run the shop, and only as much as they need:
- Stripe, our payment provider, which processes your payment and carries out fraud checks. You can read Stripe’s privacy policy at stripe.com/privacy.
- Our website hosting provider, which stores the website and its data on its servers.
- Delivery companies, which receive your name, delivery address and, where needed, your contact details so they can deliver your order.
- Email service providers that we use to send order emails and, if you have signed up, our newsletter.
- Professional advisers, such as our accountants, where needed to run the business.
These providers act on our instructions, except where they use information to meet their own legal or regulatory obligations (for example, Stripe as a regulated payment provider). We may also share information where the law requires it, or to protect our rights, for example to prevent fraud.
Transfers outside the UK
Some of our providers, including Stripe, may process your information outside the UK. Where this happens, we make sure it is protected by safeguards recognised under UK data protection law, such as UK adequacy regulations or approved data transfer contracts.
How long we keep it
- Orders, payments and refunds: six years from the end of the financial year in which the order was placed, to meet our tax and accounting obligations.
- Customer accounts: until you ask us to close your account (we still keep order records for the period above).
- Newsletter: until you unsubscribe.
- Messages and enquiries: for as long as we need to deal with them and any follow-up.
After that, we securely delete or anonymise your information.
Cookies
Cookies are small files stored on your device. We only use cookies that are needed to run the shop:
- basket and session cookies set by WooCommerce, our shop software, so the site remembers what is in your basket and can complete your order
- login cookies set by WordPress if you sign in to your account
- cookies set by Stripe at the checkout to process payments securely and prevent fraud
These cookies are strictly necessary, so they do not need your consent. We do not currently use analytics or advertising cookies; if we add any, we will update this policy and ask for your consent first. You can block or delete cookies in your browser settings, but the basket and checkout will not work without them.
Your rights
Under UK data protection law, you have the right to:
- ask for a copy of the personal information we hold about you
- ask us to correct information that is wrong or incomplete
- ask us to delete your information
- ask us to restrict how we use your information
- object to how we use your information, including for direct marketing
- ask us to transfer your information to you or to another organisation
- withdraw your consent at any time, where we rely on consent
Some of these rights only apply in certain circumstances. To make a request, contact us by email at invigortex@gmail.com or via our Contact page. There is normally no charge, and we will reply within one month.
Keeping your information safe
We use appropriate technical and organisational measures to protect your information, and only people who need it to run the shop can access it.
Complaints
If you are unhappy with how we have handled your information, please contact us first so we can put it right. You also have the right to complain to the Information Commissioner’s Office (ICO), the UK’s data protection regulator, at ico.org.uk/make-a-complaint.
Changes to this policy
We may update this policy from time to time. The latest version will always be on this page, with the date it was last updated.
